PRIVACY STATEMENT
Marieke Miki - Illustration & Design is responsible for the processing of personal data as shown in this Privacy Statement. This Privacy Statement describes how and when I, Marieke Miki - Illustration & Design, collect, use, and share information when you contact, or otherwise use my services through the site mariekemiki.com or its related sites and services. This Privacy Statement is for the website mariekemiki.com and governs the privacy of its users.
This Privacy Statement does not apply to the practices of third parties that I do not own or control, including Google, Etsy, Instagram, or any third party services you access through the site (which is supported by Google Site), listed below.

1. Information I collect
I collect your personal data because you use my services and / or because you provide this information to me yourself.
To contact me and work with me, you must provide me with certain information, such as your name, email address and message via email/message via contact form and, if you work with me, additionally your postal address, payment information, your business VAT ID (if applicable of course), and the details of the service that you are ordering. You may also choose to provide me with additional personal information (for a custom order of an illustration or poster, for example).
2. Special and/or sensitive personal data that I process
My website and/or service does not intend to collect data about website visitors who are younger than 16 years old. Unless they have permission from parents or guardians. However, I cannot check whether a visitor is over 16. I therefore advise parents to be involved in the online activities of their children, in order to prevent data about children from being collected without parental consent. If you are convinced that I have collected personal information about a minor without this permission, please contact me at hello@mariekemiki.com, then I will delete this information.
3. For what purpose and on what basis I process your data
I rely on a number of legal bases to collect, use, and share your information, including:
- As needed to provide my services, such as when I use your information to fulfil the service you ordered, to settle disputes, or to provide customer support;
- Handling your payment;
- Being able to call or email you if this is necessary to perform my services;
- If necessary to comply with any applicable laws and regulations, a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchase and our working relationship if required by tax law; and
- As necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as (a) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services; and (b) Compliance with the Google Terms of Use.
4. I do NOT use Automated Decision-Making
I do NOT use Automated Decision-Making. These are decisions that are made by computer programs or systems, without a person (for example, an employee of Marieke Miki - Illustration & Design) is in between. I do NOT use any such computer programs or systems.
5. Information sharing and disclosure
I do not sell your information to third parties and will only provide it if this is necessary for the execution of our agreement with you or to comply with a legal obligation.
Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:
- Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Some third parties that will collect your data that I do not have any control over or own, you can access to this site, these are:

6. How I collect information
When you fill in the Google Contact Form on my website, as part of the process, I collect your name, your email address and the message you write. When you write me an email, I collect your email address and anything you share in the email message. When we start a working relationship together, after you contacted me, I will ask you to release, if necessary, information like your name, address, payment information and your business’s VAT ID. We will also enter a Project Information Agreement, in which more details about the project will be collected (see Terms & Prices).
Your personal information will be used for the specific reasons stated above only.
7. Data retention
I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Statement. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 7 years, as determined by Dutch law.

I may also store information on external hard drives.
8. Transfers of personal information outside the EU
I may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If I am deemed to transfer information about you outside the EU, I rely on Privacy Shield as the legal basis for the transfer, as Google Cloud is Privacy Shield certified.
9. Cookies and similar techniques
The only cookies on the website are placed by third parties, since the website mariekemiki.com is built with Google and I use Google services. So please read Google’s Privacy Statement (click HERE to see Google’s Privacy Statement).
A cookie is a small text file that is stored in the browser of your computer, tablet or smartphone when you visit this website. Functional cookies ensure that the website works properly and that, for example, your preferred settings are remembered. 10. Your Rights
If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:
10.1 Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.
10.2 Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request.
10.3 Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
10.4 Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
11. Communication
I may contact you to notify you regarding your transactions, to troubleshoot problems with your transactions, to resolve a dispute, to collect fees or monies owed, or as otherwise necessary to contact you to enforce applicable national laws, and any agreement I may have with you. For these purposes, I may contact you via email, telephone, text messages, and postal mail.
12. How to ask me to stop holding your information
If you no longer want me to hold or process your data, please contact me. I will delete all the data that I am not required to retain to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements.
